Can I pay my non-exempt employees a salary?
You can pay non-exempt employees a salary however, they are still entitled to over time pay, for hours worked over 40 hours in a work week. The regular hourly rate of pay is divided by the number of hours expected to work in the week into the weekly salary. The employee is entitled to be paid the regular rate of pay for the 40 hours worked and time and a half for any hours over the 40 hours.
